Poland’s Free Hand to Black Market Gambling

The Polish legal framework on online gambling has led to a paradoxical situation in which players themselves, when using the services of foreign operators without a license, are exposed to criminal liability. As a result, victims of fraud remain silent, while the black market continues to thrive, since the state is unable to effectively enforce the law against entities operating from tax havens. A realistic solution could involve focusing enforcement efforts on intermediaries present in Poland, such as payment platforms or influencers promoting illegal gambling, as well as amending the law towards greater protection of consumers acting in good faith. Effective action against this phenomenon also requires broader cooperation at the EU level and increased public awareness of safe gambling practices.
